A Japan Court Rules Samsung Didn't Infringe Apple

Apple's (AAPL) big patent-infringement legal win over Samsung in U.S. courts is not carrying over to other parts of the world.

A Tokyo judge on Friday ruled that Samsung Electronics didn't infringe on Apple patents related to smartphones and tablet computers synchronizing music and video data with servers.

Apple was ordered by Tokyo District Judge Tamotsu Shoji to pay costs of the lawsuit after his verdict, Bloomberg reported. South Korea-based Samsung's shares rose 1.5% on the Seoul exchange Friday.

Apple's U.S. shares, though, were up a fraction in early U.S. trading Friday, at 667.30, near their all-time high of 680.87 touched on Monday, the first trading day after the U.S. verdict was announced late Aug. 24.

That verdict was a resounding legal win for the Cupertino, Calif.-based iPhone maker.

But earlier on Aug. 24, a Korean court ruled that Apple and Samsung had infringed on one another's patents, and Apple in general hasn't seen resounding legal wins worldwide. And the legal battles between the two leading makers of smartphones is far from over, as we've reported.

U.S. District Court Judge Lucy Koh is slated to rule Sept. 20 on Apple's request, following the Aug. 24 verdict, to block U.S. sales of eight Samsung products. Samsung is fighting the request.

And Reuters reported late Thursday that Apple CEO Tim Cook and Google CEO Larry Page have had behind-the-scenes talks regarding patents. Samsung, and many others, makes smartphones and tablets based on Google's open-source Android operating system. Apple's win over Samsung was widely viewed as also a win over Google and Android.

Pfizer licenses potential immune cancer drug

NEW YORK (AP) ? Pfizer Inc. will work with privately held biotechnology company VLST Corp. on a potential immune therapy for cancer.

VLST said Friday it plans to start testing the drug, designated CP-870,893, as a treatment for cancer in mid-stage clinical trials. The Seattle company has conducted early-stage trials of the drug and said it recently secured $5 million in financing to help fund mid-stage studies.

Pfizer and VLST will share the rights to develop and market the drug as a "cancer vaccine," or a therapy that is designed to stimulate the immune system to fight cancer.

Shares of New York-based Pfizer gained 6 cents to $23.90 in morning trading.

Cooler waters help diminish Isaac's punch

ScienceDaily (Aug. 29, 2012) ? Seven years after the powerful Category 3 Hurricane Katrina caused widespread devastation along the Gulf Coast, a Category 1 Hurricane Isaac, with maximum sustained winds of 80 miles per hour (70 knots), made landfall Aug. 28 in southeast Louisiana. And one of the reasons why Isaac is not Katrina is the path it took across the Gulf of Mexico and the temperature of the ocean below, which helps to fuel hurricanes.

In 2005, Hurricane Katrina's maximum wind speeds increased dramatically as the storm passed over a warm ocean circulation feature called the Loop Current that is part of the Gulf Stream. The storm evolved quickly from a Category 3 to a Category 5 event on the Saffir-Simpson Hurricane Wind Scale in a matter of nine hours as it drew heat from the Loop Current. It subsequently dropped in intensity to a Category 3 storm at landfall.

Because the Loop Current and its eddies are warmer, and thus higher in surface elevation, than the surrounding waters, they are easily spotted by satellite altimeter instruments, such as those aboard the NASA/French Space Agency Jason 1 and Ocean Surface Topography Mission/Jason 2 satellites. Scientists use the latest satellite measurements of sea-surface height from these and other satellite altimeters to create maps showing the location, direction and speed of currents in the Gulf of Mexico.

This color-enhanced image of sea surface heights in the northeastern Gulf, produced using data from available satellite altimeters, including NASA's Jason-1 and Jason-2 satellites, shows Isaac's path through the Gulf. The storm skirted around the Loop Current, then caught the outer edge of a warm eddy before passing directly over a cold eddy. The storm's track away from the Gulf's warmest waters has helped to keep Isaac from intensifying rapidly, as Hurricanes Katrina and Rita did in 2005.

Warm eddies have high heat content and great potential to intensify hurricanes, whereas cold eddies have low heat content and may even cause hurricanes to weaken, as was the case with Hurricane Ivan in 2004.

Wheat scientists seek to slow crop fungus in Africa, Asia

OSLO (Reuters) - Wheat experts are stepping up monitoring of a crop disease first found in Africa in 1999 to minimise the spread of a deadly fungus that is also a threat in Asia, experts said on Friday.

A "Rust-Tracker", using data supplied by farmers and scientists, could now monitor the fungus in 27 developing nations across 42 million hectares (103 million acres) of wheat - an area the size of Iraq or California.

"It's the most serious wheat disease," Ronnie Coffman, vice-chair of the Borlaug Global Rust Initiative (BGRI), told Reuters ahead of a meeting of wheat experts in Beijing from September 1-4.

"If it gets started...it's like a biological firestorm," he said. Experts will review progress in combating the disease, with fungicides and 20 new resistant varieties developed in recent years.

The stem rust disease, forming reddish patches on plants like rust on metal, is known as Ug99 after it was found in Uganda in 1999. It has since spread as far as South Africa and north to Yemen and Iran.

The fungus, which can destroy entire wheat fields, is likely eventually to be carried worldwide on the winds. The biggest threat in coming years is a spread across Asia to Pakistan, India and China, the world's top producer, Coffman said.

"Effective control often depends on finding out what is happening in distant regions, and the Rust-Tracker can help scientists assess the status of stem rust and other rust diseases," said Dave Hodson, the developer of Rust-Tracker.

About 85 percent of wheat now in production worldwide was reckoned to be vulnerable to Ug99 and its variants, the BGRI estimated. Rich nations are far less vulnerable because they can afford to switch to new varieties or deploy fungicides.

FRONT LINE

Among developing nations, Afghanistan, Bangladesh, Ethiopia, Egypt, India, Kenya, Nepal and Pakistan are on the front line of deploying rust-resistant varieties.

Coffman said that relatively minor amounts of wheat output had been lost so far. "The only country under immediate threat of a dramatic loss of production is Ethiopia," he said.

In Kenya, for instance, Ug99 had been brought largely under control because of shifts to new varieties. Another threat was from yellow rust, which has struck nations from Morocco to Uzbekistan in recent years.

The Ug99 fungus is among threats to food supplies. A U.N. panel of scientists says that heat waves, floods and droughts -- like the one affecting the United States this year -- are likely to become more frequent because of manmade climate change.

Scientists were also studying ways to limit a woody plant known as barberry, where the fungus also lives. Efforts to eradicate the plant in the 20th century seem to have reduced rust.

And the rust had overcome a genetic resistance to the disease developed for wheat in the early 1970s by Norman Borlaug, the father of the "Green Revolution" that introduced higher-yielding crop varieties, Coffman said.

He said that rust had been known at least since Roman times. About 40 percent of the U.S. crop was destroyed in the early 1950s when rust swept up from Mexico.

GOP Nominees Didn't Always Run As Bellicose Nationalists

Comparing Mitt Romney's RNC speech to what the last Republican president with a successful foreign-policy record said


My colleague James Bennet, The Atlantic's editor, points to the speech above, George H.W. Bush's acceptance speech at the 1988 RNC, as one of the most successful convention speeches of the modern era. I watched it on television, but I was also only eight years old at the time, so I returned to it last night, and it only deepened my nostalgia for a bygone Republican Party. I prefer the elder Bush to his son, to Bob Dole, to John McCain, and to Mitt Romney.

I prefer him to Barack Obama too.

One reason among several is the way that he talked about war. His words reflected the hard won wisdom of World War II veterans much more than the bellicose rhetoric of today's Republican hawks, many of whom never served and know war only as an abstract intellectual exercise. It is no surprise that they see war as ennobling, and urge more of it. The elder Bush was different.

He spoke about liberals and American exceptionalism in ways that would fit in Republican speeches today (that is to say, he marshaled nationalist rhetoric):

My opponent's view of the world sees a long slow decline for our country, an inevitable fall, mandated by impersonal, historical forces. But America is not in decline. America is a rising nation. He sees America as another pleasant country on the U.N. roll call, somewhere between Albania and Zimbabwe. And I see America as the leader, a unique nation with a special role in the world. This has been called the American century because in it we were the dominant force for good in the world. We saved Europe. Cured polio. Went to the moon. And lit the world with our culture. And now we're on the verge of a new century. And what country's name will it bear? I say it will be another American century. Our work is not done, our force is not spent.
This is where John McCain or Condoleezza Rice would launch into a defense of interventionism abroad, and suggest that the American military should be lengthening its occupations, intervening in countries where boots aren't currently on the ground, and advancing our values through the force of arms.

Here's what Bush said next:

There are those who say there isn't much of a difference this year, but America, don't let them fool you. Two parties this year ask for your support. Both will speak of growth and peace. But only one has proved it can deliver. Two parties this year ask for your trust. But only one has earned it.
Eight years ago I stood here with Ronald Reagan and we promised together to break with the past and return America to her greatness. Eight years later look at what the American people have produced. The highest level of economic growth in our entire history. And the lowest level of world tensions in more than 50 years. ?
Later in the speech, he said this:
Our economic life is not the only test of success. One issue overwhelms all the others. And that's the issue of peace. And look at the world on this bright August night. The spirit of democracy is sweeping the Pacific Rim. China feels the winds of change. New democracies assert themselves in South America. And one by one, the unfree places fall, not to the force of arms but to the force of an idea: freedom works. We have a new relationship with the Soviet Union, the INF treaty, the beginning of the Soviet withdrawal from Afghanistan, the beginning of the end of the proxy war in Angola, and with it the independence of Namibia, Iran and Iraq move toward peace. It's a watershed.
It is no accident. It happened when we acted on the ancient knowledge that strength and clarity lead to peace, weakness and ambivalence lead to war. You see weakness tempts aggressors. Strength stops them. I will not allow this country to be made weak again. Never. The tremors in the Soviet world continue. The hard earth there has not yet settled. Perhaps what is happening will change our world for ever and perhaps not. A prudent skepticism is in order. And so is hope. But either way we are in an unprecedented position to change the nature of our relationship, not by preemptive concession, but by keeping our strength. Not by yielding up defense systems with nothing won in return but by hard, cool engagement in the tug and pull of diplomacy.? ? ?
This isn't, you'll note, the speech of an "isolationist." Neither is it a speech anyone in the mainstream of the GOP would give today. It extols spreading freedom through strength of ideas rather than arms, and expresses the power of diplomacy to solve problems even between America and "the Evil Empire."

Said Bush in the next line:

My life has been lived in the shadow of war. I almost lost my life in one. And I hate war. I love peace. And we have peace. And I am not going to let anyone take it away from us.
Mitt Romney didn't say he hated war in his acceptance speech at the RNC on Thursday night. He didn't promise to preserve peace, and he certainly didn't extol diplomacy -- he mocked the notion of talking to our enemies.

Here's the sum of his foreign policy remarks:

President Obama began with an apology tour. America, he said, had dictated to other nations. No Mr. President, America has freed other nations from dictators. Every American was relieved the day President Obama gave the order, and Seal Team Six took out Osama bin Laden. But on another front, every American is less secure today because he has failed to slow Iran's nuclear threat.

In his first TV interview as president, he said we should talk to Iran. We're still talking, and Iran's centrifuges are still spinning. President Obama has thrown allies like Israel under the bus, even as he has relaxed sanctions on Castro's Cuba. He abandoned our friends in Poland by walking away from our missile defense commitments, but is eager to give Russia's President Putin the flexibility he desires, after the election. Under my administration, our friends will see more loyalty, and Mr. Putin will see a little less flexibility and more backbone. We will honor America's democratic ideals because a free world is a more peaceful world. This is the bipartisan foreign policy legacy of Truman and Reagan. And under my presidency we will return to it once again.

Forget the absurdity of the Cuban embargo. Look past the distortions about Obama's relationship with Israel. As Daniel McCarthy noted, anyone with an ounce of realist foreign policy inclinations will be sent running by Mitt Romney's speech, especially coming after addresses from John McCain and Condaleeza Rice that confirm the people running the GOP right now aren't chagrined by the failures of Bush-era foreign policy. They're proud of those years.

They intend to return to them.

In doing so, they pretend they're returning to a decades long, "bipartisan foreign policy legacy," but it isn't so, as George H.W. Bush's speech demonstrates. The fact that the elder Bush uncritically supports Romney, even as the former Massachusetts governor's team makes a mockery of prudence in foreign affairs, is to his discredit. This time Elder Bush doesn't have the understandable excuse of not wanting to undermine his own son. The (mostly elderly) foreign policy adults who still have sway among Republicans ought to start speaking up against the direction of the party.

As we saw this week in Tampa, the Pauls can't do it alone.

Kentucky Health News: State's largest health care system says it will ...

KentuckyOne Health, the state's largest health-care system with almost 200 hospitals, physician groups, primary care centers and other agencies, is canceling its contracts with Coventry Cares, one of the state's four Medicaid managed-care organizations. Terminations will be effective Nov. 1 for Jewish Hospital & St. Mary's HealthCare?and?Saint Joseph Health System.

The decision came after Coventry sent a letter announcing it would terminate its contract July 18 with Our Lady of Peace hospital in Louisville. Coventry also terminated its contract with Taylor Regional Hospital in Campbellsville, another KentuckyOne facility, reports Valarie Honeycutt Spears for the Lexington Herald-Leader. She notes that?Our Lady of Peace serves high-risk patients with intellectual disabilities. It is one of the largest private, non-profit psychiatric hospitals in the country.

"We feel Coventry Care's actions will ultimately hinder and prevent the care our communities need and deserve," said Barbara Mackovic, a KentuckyOne spokeswoman. "That is especially true when a plan would put our most vulnerable patient populations at Our Lady of Peace at risk."

Issues with Coventry Cares have been mounting ever since it started administering Medicaid Nov. 1. The company, the state and Appalachian Regional Healthcare?fought in court after Coventry threatened to terminate its contract. TCoventry temporarily extended its contract, but in in May the firm announced it would also end contracts with Baptist Healthcare System.

Managed care has saved the state money but has caused major headaches, including delayed provider payments and overly-burdensome preauthorizations. Coventry alleges "that it has too many high-risk patients and that the state needs to adjust the risk model so Coventry can receive more money for sicker patients," Spears reported in May. Pinterest finally launched an Android app, offering all of the scrapbooking appeal of the growingly popular social network in a mobile format. Right off the bat, it’s clear that the Pinterest guys took their time and made sure that experience was as smooth and reliable as the web version.

12-year-old CJ Adams (the ?C? is for Cameron) got his acting start playing Steve Carrell?s nephew in the movie Dan in Real Life when he was only six. We sat down at a posh hotel near Rodeo Drive in Beverly Hills to find out how CJ enjoyed pretending he couldn?t play soccer (he?s actually very good at it), what it was like having cool Jennifer Garner (13 Going on 30) play his mom and just how hard it was to be covered in mud and have water thrown on him in 30 degree weather!

Kidzworld: What did you think when you were told that you could audition for a movie where you?d play a boy who just magically grew out of the garden??

  • CJ: When I first heard it, I knew the kid was special because he grew out of the garden. Me and my mom read the script and he had all this personality and I was like ?That IS me right there!? So, we tried out for it. I felt really strong about it. I didn?t think he was weird or anything, just special.

Kidzworld: The mom and dad in the movie write down a wish list of qualities for a kid who would be perfect for them.? If you could make a list of wanted qualities in a mom and dad, what would they be?

Kidzworld: Pretty cool list. So if you were going to explain where Timothy comes from and why to a friend your age, what would you say? He?s magical or he?s from God or he?s from Mother Nature?

  • CJ: I think Timothy is a gift from God sent down to teach (parents) Jim and Cindy that they can love anyone whether he?s adopted or not, you can still love that child.

Kidzworld: The first time we see you, you are covered in mud. How icky was that and what was it really made of?

  • CJ: It wasn?t mud but they said it was ?clean dirt?. We filmed in like a 32 degree garage and when it dried up, they had to keep it moist so they?d spray me with water. Aaaaaa, it?s so cold!!

Kidzworld: How was having a pretty hot older actress (15) Odeya Rush play your friend Joni in the movie? Was she really nice?

  • CJ: Yeah, she was a really good friend on the set. During the Superbowl, she and her family and my family all went to a restaurant and watched it.

Kidzworld: How fun was riding the bike with Odeya? You are all cramped up in front of her. Was that really uncomfortable?

  • CJ: The seat was the widest thing ever so I had some space and I?d hold on to the bar and just chill. I don?t think we ever fell over.

Kidzworld: Did you get to do anything else fun off set?

  • CJ: I wish but off set I would be doing school.

Kidzworld: Since you really do play soccer, how crazy was it to have to pretend you were tripping over the ball and weren?t very good at it at first? Was that frustrating or just fun?

  • CJ: I thought back to the beginning of everything because, in order to learn, you have to have mistakes so I thought of those mistakes and I always remembered that if I messed up on a ball my foot would roll over so I thought, if I roll it over, I?ll trip on it and fall down. It worked.

Kidzworld: How was having Jennifer Garner as your mom?

  • CJ: She made me feel really comfortable acting. We?d do the lines and she?d do them perfect then I?d be like, ?Oh, okay I feel comfortable. There?s nothing to be afraid of?, then I?d remember my lines.

Kidzworld: What was your favorite scene?

  • CJ: Probably my underwater scene (he stays at the bottom of a pool) because I learned how to scuba dive. For hours on end we?d have to sit underwater and breathe a little bit (on a scuba tank), then give the guy the driving gear, then do the scene and, they?d give me more air. Sometimes, I?d forget that I could get air so I?d swim up to the surface to get it. Where did he go?

Kidzworld: Who was the jokester on the set?

  • CJ: That was Joel Edgerton (who plays CJ?s dad in the movie). There was one scene where he would do a long monologue. It was getting late and we were tired. He would make me laugh. Instead of doing the lines about all the things that I (Timothy) wanted to build, he?d say it was all the things I wanted to burn down with fireworks. Everyone started laughing on set.

Kidzworld: You?ve worked once before when you were only six with the same director (Peter Hedges in the Steve Carell movie Dan in Real Life). So, now that you are older, did you get to suggest things for your character Timothy to do?

  • CJ: Every once in a while I?d say ?I?m not feeling so good about that. What if I did it like this?? and he?d be like ?Oh, yeah. maybe we should try that? and a couple of times, (what I suggested) got in there.

Kidzworld: When you grow up do you want to write and direct movies?

  • CJ: Yeah, that and helping others is probably my main move. I like movies so far, I?m thinking I might stick with that.

Kidzworld: What is a book you?ve read lately that you really like?

  • CJ: I?ve been reading the book ?The Adventures of Tom Sawyer? and I love it. It?s so adventurous.

Kidzworld: What music artists or bands are you into?

  • CJ: I don?t have a special band but I like pop a lot and the latest music on the radio.

Kidzworld: Do you have a favorite subject in school?

Kidzworld: Do you want to play a superhero someday? If so, which one?

  • CJ: Yes! Captain America!

Kidzworld: Well, I think Chris Evans has the lock on that one right now.

  • CJ: Young Captain America?

USDA buys meat to help drought-stricken farmers

WASHINGTON (AP) ? The Agriculture Department will buy up to $170 million of pork, lamb, chicken and catfish to help drought-stricken farmers and ranchers.

USDA Secretary Tim Vilsack says the purchase for food banks and other federal food nutrition programs will help producers struggling with the high cost of feed.

The announcement comes as President Barack Obama campaigns in Iowa, where he criticized Republican vice presidential candidate Paul Ryan for blocking a farm bill that could help farmers cope with the drought.

Obama has pledged a wide-ranging response to the worst drought in a quarter-century.

His administration is giving farmers and ranchers access to low-interest emergency loans, opening more federal land for grazing and distributing $30 million to get water to livestock.

Refinery fire site too dangerous for investigators

SAN FRANCISCO (AP) ? Federal and state investigators were trying to determine how to safely enter the area where a fire broke out in a Chevron refinery last week so they can examine a failed pipe blamed for the blaze.

Structural engineers on Monday determined the damaged crude unit that was the site of the fire in the facility was too hazardous to enter. The eight-inch pipe leaked and its contents ignited, sending black smoke into the sky above Richmond, Calif., and thousands of nearby residents to hospitals with complaints of eye irritation and breathing difficulty.

Investigators were discussing plans on how to make the unit safe so the faulty pipe could be removed for testing, said Hillary Cohen, a spokeswoman for the U.S. Chemical Safety Board.

"The crude unit is still off-limits because of safety concerns. Probably for another day or two," said Peter Melton, a spokesman for the state division of occupational safety and health, or Cal-OSHA. That agency is also investigating the cause of the blaze.

The Aug. 6 conflagration destroyed an area of the refinery that produces a large amount of the gasoline that satisfies California's clean-air regulations, which are the toughest in the nation. Other parts of the refinery, which supplies 16 percent of California's daily gas consumption, are still producing fuels.

But the refinery's reduced output has sent state gas prices rising higher than normal, analyst said. The average price for a gallon of regular on Monday in California was $4.07, up from $3.86 last Tuesday.

The small leak in the pipe was discovered quickly by Chevron's engineers, a fact that may have helped save their lives, said Randy Sawyer, chief environmental health and hazardous materials officer for Contra Costa County, where the refinery is located. The company has set up a claims center to help residents seeking compensation from exposure to the smoke.

When the crew of more than a dozen people removed insulation to inspect the decades-old pipe, they were engulfed in a cloud of vapor and narrowly escaped the unit before the fire ignited, investigators from the U.S. Chemical Safety Board said.

"It was good they found the leak early ... the sooner you find the (leak) and ignition point, the less fuel there is to burn at the ignition point," Sawyer said.

Investigators want to learn why Chevron did not replace the old pipe that failed, and suspect corrosion as a likely cause of the leak. The company had inspected the unit in November and replaced a larger corroded pipe that was connected to the one that failed, federal investigators said.

"Investigators continue to be onsite and we are fully cooperating with them to move this investigation forward," said Melissa Ritchie, a company spokeswoman.

Whether or not their HIV condition is under control and is not deemed to be infectious, the Criminal Code of Canada states they are legally obliged to disclose their HIV status to their sexual partners.

Criminal charges can be laid if they ignore that obligation.? And they could be facing charges ranging from aggravated sexual assault to murder.? In fact, there have been instances where heterosexual men have not divulged their status to female partners and the women subsequently learned they were infected, and some of those women have died of HIV-related causes as a result.

People with HIV must maintain their condition to ensure it is under control with life-long regular medical checkups that monitor viral loads and CD4 cell counts.? the viral load represents the amount of HIV in someone's bloodstream; the higher the viral load, the faster the CD4 cell count falls, which impacts the body's immune response, increasing opportunistic infection potential.

When the viral load is diminished dramatically or undetectable there is then little to no opportunity of transmission to someone else.? Those with a dropped CD4 count resulting from high viral loads must take daily medication to reverse the situation.? And as a result of the availability of antiretrovirals HIV has been altered from representing a death sentence to having a disease that can be treated, not cured.

In 1998 the Supreme Court of Canada ruled that people with HIV had a legal obligation to inform someone before taking part in sexual acts, that they have a disease carrying a "significant risk".? Violation of that law is liable to prosecution, whether or not the virus is transmitted.?

"Unfortunately, I think it is normalizing (criminalization).? It is bringing the criminal law and the language of the legal system into everyday discussion of HIV.? It becomes more natural to use criminal law to describe something that is a health issue.? It is a medical diagnosis that is determining potential criminality", explains an objector, Patrick O'Byrne, Associate professor at University of Ottawa.

On the other side of the equation is the opinion of Carissima Mathen, law professor at the University of Ottawa.? "It's an issue about the conditions under which people are entitled to choose with whom they have sexual contact.? It is a personal autonomy and a personal choice issue that the criminal law seeks to protect."

"But I do think that a person is entitled to that information if they ask for it.? If you don't give it to them, we are entitled to look into the why and I think there is the possibility that a crime has occurred."
